Treasured Moments Travel Terms of Service

By enlisting the services of, and purchasing travel through, Lisa Dunne/Treasured Moments Travel, you agree that the purchase of your travel booking constitutes a legally binding agreement between the traveller(s) and/or purchaser(s) (referred to herein as “Traveller”, “You”, or “Your”) and Lisa Dunne/Treasured Moments Travel (referred to herein as “the Agency”, “We”, “Us”, or “Treasured Moments Travel”). These Terms of Service govern all bookings and services provided by the Agency.
Our Core Value — Transparency, No Surprises: We believe in clear, upfront communication. We will do our best to ensure there are no surprises about fees, supplier rules, or travel-related risks. Please read these Terms of Service carefully and ask questions before you pay any deposit or make any booking changes.
1. Role of Treasured Moments Travel (Travel Advisor) & Supplier Relationship
Treasured Moments Travel acts solely as a Travel Advisor and as an intermediary (booking agent) between you and third-party travel suppliers, including (without limitation) airlines, cruise lines, hotels, resorts, tour operators, and transportation providers (“Suppliers”). Payment for your travel booking binds you to the terms and conditions of each respective Supplier.
Treasured Moments Travel does not own, manage, or operate any Supplier services and does not control the actual delivery of travel services. If a Supplier is unable to provide the services for which you have contracted, your legal recourse lies directly against the Supplier and not Lisa Dunne/Treasured Moments Travel.
2. Professional Designations, Expertise, and Specialised Support
Lisa Dunne is a Certified Travel Counsellor (CTC) and a Certified Cruise Counsellor. Treasured Moments Travel also provides specialised travel support as a Certified Autism Travel Professional. While we provide expert guidance and personalised itineraries based on professional designations and insider knowledge, our recommendations are based on information provided by Suppliers. We cannot guarantee the accuracy of Supplier information and are not liable for Supplier products and services that do not meet your subjective expectations. While we strive to ensure all specific needs are communicated to Suppliers, the ultimate execution of accommodations and on-site support remains the responsibility of the Supplier.
3. Fees (Planning, Group Rooms, Changes, and Cancellations)
All Treasured Moments Travel fees are non-refundable and subject to HST, unless we expressly agree otherwise in writing. Supplier fees and penalties may also apply in accordance with the applicable Supplier terms and conditions.
Planning Fees (when applicable):
- No planning fee is charged for All-Inclusive Vacations, Cruises, and Packaged Tours.
- For Custom FIT (Fully Independent Traveller) planning, any planning fee(s) will be disclosed and agreed upon before any work commences. Any such planning fees (once agreed) are non-refundable and subject to HST.
Fee Schedule (non-refundable; plus HST):
- Group Room Fee: $100 + HST.
- Change Fee: $100 + HST per booking.
- Cancellation Fee: $135 + HST per booking (not per passenger).
These fees are mandatory where applicable and are not covered by Supplier change/cancellation policies.
4. Traveller Responsibilities (Documentation, Accuracy, and Communication)
Documentation & Entry Requirements: It is your sole responsibility to ensure that all required travel documents are valid and meet the entry requirements of your destination and any transit points, including (without limitation) passports, visas, health certifications, vaccination requirements, and any other government-mandated documentation. Passport validity rules vary by destination; however, passports should typically be valid for at least six (6) months beyond your date of return. Treasured Moments Travel is not responsible for denied boarding, denied entry, or other losses arising from insufficient or invalid documentation.
Accuracy: You must verify that the names on your booking documents exactly match your government-issued identification.
Accuracy of Documentation: The traveller must review all booking confirmations and travel documents immediately upon receipt. Any errors or discrepancies must be reported to the Travel Advisor within 24 hours of receipt. Any changes or corrections reported after this 24-hour window will be subject to the standard terms, conditions, and fees of the supplier and the Travel Advisor.
Check-in: It is your responsibility to confirm flight departure times 24 hours in advance. We recommend checking in 24 hours prior to flights and 72 hours prior to cruises.
Communication: You must provide the Agency with current contact information to ensure you receive timely updates regarding schedule changes or travel requirements. You may contact Treasured Moments Travel at 289-797-2927.
5. Price Availability and Increases (TICO / Ontario Travel Industry Act Compliance)
All prices and availability are subject to change by the Supplier until full payment is received. In accordance with the Travel Industry Council of Ontario (TICO) and Ontario’s Travel Industry Act, 2002 and related regulations, if a price increase occurs that is more than 7% of the total price (excluding increases resulting from government-imposed taxes such as HST or GST), you have the right to cancel the contract and obtain a full refund. No price increases are permitted after the booking has been paid in full.
6. Travel Protection and Insurance
Treasured Moments Travel strongly recommends the purchase of comprehensive travel insurance to protect your investment against unforeseen events, including medical emergencies, trip cancellations, or interruptions. As insurance policies are administered by third-party providers, Treasured Moments Travel cannot guarantee claim outcomes and is not responsible for the submission of claims.
7. Liability, Supplier Defaults, and Hold Harmless
Treasured Moments Travel is not liable for any negligent acts, omissions, or failures to act by any Supplier. We are not responsible for any injury, loss, death, damage to property, delay, or inconvenience caused by, without limitation:
- Supplier bankruptcy or insolvency;
- strikes, civil unrest, or terrorism;
- natural disasters, weather events, or pandemics;
- differing living standards, utility interruptions, or renovations at the destination.
While we specialise in accessible and autism-friendly travel, the implementation of specific accommodations is the sole responsibility of the Supplier.
Hold Harmless: To the fullest extent permitted by law, you agree to hold harmless Treasured Moments Travel, Lisa Dunne personally, and the host agency, Nexion Travel Group Canada, from and against any and all claims, demands, causes of action, losses, damages, liabilities, fines, penalties, costs, and expenses (including reasonable legal fees) arising from or related to your travel arrangements and travel services, including Supplier acts or omissions, Supplier defaults (including bankruptcy/insolvency), and/or your own acts, omissions, negligence, or failure to comply with these Terms of Service or Supplier requirements.
8. Force Majeure
Treasured Moments Travel is not responsible for any delays or failures to perform resulting from causes outside its reasonable control, including but not limited to, acts of God, weather, natural disasters, pandemics or public health emergencies, travel advisories, border closures, government actions or restrictions, war, terrorism, civil unrest, labour disruptions, Supplier insolvency, or interruptions to transportation or utilities. Where applicable, your rights and remedies (including cancellation rights and refunds) are subject to the terms and conditions of the applicable Supplier and any requirements under the Travel Industry Act, 2002 and TICO regulations.
9. Privacy
We are committed to protecting your personal information. Personal data is collected solely for the purpose of making travel reservations on your behalf. Your information will be handled in accordance with Canadian privacy laws and will not be shared with third parties outside of the necessary booking requirements.
10. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada.
11. Acknowledgment and Consent
Agreement to these Terms of Service is acknowledged by any of the following actions:
- handwritten or electronic signature;
- written acknowledgment via email;
- the act of making a payment (deposit or full payment) toward a booking; or
- the use of travel services provided by Treasured Moments Travel.
By proceeding with your booking, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
